Terms of Service

These Terms of Service ("Terms") govern your use of azovgroup.com and the BuildTrack Pro construction management platform (collectively, the "Service") operated by Azov Group LLC ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

Service Description

BuildTrack Pro is a construction project management platform designed for real estate investors and contractors. The Service provides tools for project budgeting, expense tracking, vendor management, draw requests, deal analysis, and related construction management workflows.

Account Terms

To access BuildTrack Pro, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, are used for unauthorized purposes, or remain inactive for an extended period.

SMS and Messaging Terms

By providing your phone number and using the Service, you consent to receive transactional SMS messages from BuildTrack Pro. These messages are limited to:

• Two-factor authentication (2FA) verification codes
• Project status notifications and alerts
• Investor updates and capital call notifications
• System alerts related to your account

These messages are transactional in nature — we do not send marketing or promotional messages via SMS. Message frequency varies based on your account activity.

Message and data rates may apply. Your mobile carrier's standard messaging and data rates apply to any SMS messages you receive from us.

Opt-out: You can stop receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message. Note that opting out of SMS may affect your ability to use 2FA and receive time-sensitive notifications.

SMS messages are delivered via Twilio. By consenting to receive messages, you acknowledge that message delivery is subject to your mobile carrier's network availability.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service's infrastructure
• Scrape, harvest, or collect data from the Service without authorization

Intellectual Property

The Service, including its design, code, features, and content, is owned by Azov Group LLC and protected by copyright and other intellectual property laws. You retain ownership of any data you upload to the Service. We do not claim any rights to your project data, financial records, or uploaded documents.

By uploading content to the Service, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Azov Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Azov Group LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Multnomah County, Oregon.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here with a new effective date and make reasonable efforts to notify affected users. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
