These Terms of Service ("Terms") govern your access to and use of BuildTrack Pro, a construction project finance management platform operated by Azov Group LLC ("we," "us," or "our") and available at azovgroup.com. By accessing or using our platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using BuildTrack Pro, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the platform. If you are using the platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration and Responsibilities
To use BuildTrack Pro, you must create an account by providing accurate and complete information, including your name, email address, and optionally your phone number. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Promptly notifying us of any unauthorized use of your account.
- Ensuring that the information you provide is accurate, current, and complete.
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
3. SMS Notifications — Consent and Opt-Out
By providing your phone number, you consent to receive autodialed SMS/text messages from Azov Group LLC for account notifications, including verification codes, two-factor authentication, project alerts, and compliance reminders.
How You Consent: Consent is given when an authorized administrator enters your phone number during account setup, or when you add or update your phone number in your account settings. Providing your phone number constitutes your express written consent to receive transactional SMS messages.
Message Frequency: Message frequency varies based on account activity. Messages are transactional only — we do not send marketing or promotional text messages.
Message and Data Rates: Standard message and data rates may apply based on your mobile carrier plan.
Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message or by removing your phone number from your account settings. After opting out, you will receive a single confirmation message. For assistance, reply HELP or email support@azovgroup.com.
Consent to receive SMS is not a condition of purchasing or using our services.
4. Acceptable Use
You agree to use BuildTrack Pro only for lawful purposes related to construction project management. You agree not to:
- Use the platform for any illegal or unauthorized purpose.
- Interfere with or disrupt the platform's infrastructure or other users' access.
- Attempt to gain unauthorized access to any part of the platform, other accounts, or connected systems.
- Upload malicious code, viruses, or harmful data.
- Scrape, crawl, or use automated tools to extract data from the platform without permission.
- Impersonate another person or entity.
- Use the platform to transmit spam, unsolicited communications, or fraudulent content.
5. Intellectual Property
All content, features, and functionality of BuildTrack Pro — including but not limited to software, code, design, text, graphics, logos, and trademarks — are owned by or licensed to Azov Group LLC and are protected by United States and international intellectual property laws.
You retain ownership of the data and content you upload to the platform. By uploading content, you grant us a limited license to store, process, and display that content solely to provide the platform's services to you.
6. Limitation of Liability
To the maximum extent permitted by applicable law:
- BuildTrack Pro is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
- We do not warrant that the platform will be uninterrupted, error-free, or secure.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
- Our total liability for any claim arising from these Terms or the use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Financial data, cost estimates, and project calculations provided by the platform are for informational purposes only and should not be relied upon as professional financial, legal, or construction advice.
7. Indemnification
You agree to indemnify and hold harmless Azov Group LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.
8. Termination
We may suspend or terminate your access to BuildTrack Pro at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at support@azovgroup.com.
Upon termination:
- Your right to access the platform ceases immediately.
- We may retain your data as required by law or for legitimate business purposes.
- You may request deletion of your data in accordance with our Privacy Policy.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms on this page and updating the "Last updated" date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Azov Group LLC regarding your use of BuildTrack Pro and supersede any prior agreements.
